10 Orders for taking evidence abroad—inferior courts

(1)

The Supreme Court of a State or Territory may, on the application of a party to a proceeding before an inferior court in that State or Territory, exercise the same power to make an order of the kind referred to in Division 1 for the purpose of that proceeding as the Supreme Court has under that Division for the purpose of a proceeding in the Supreme Court.

(2)

This section does not apply to a proceeding before a court of summary jurisdiction exercising jurisdiction under the Family Law Act 1975.
