20 Proceedings to which this Part applies

(1)

This Part applies to a proceeding, in any Australian court, that is:

(a)

a criminal proceeding for an offence against the law of the Commonwealth; or

(b)

a related civil proceeding; or

(c)

a proceeding under a proceeds of crime law.

(1A)

However, this Part does not apply to a terrorism‑related proceeding. This does not prevent testimony or any documents or things from being foreign material for the purposes of Part 3A.

Note:

Part 3A deals with use of foreign material in terrorism‑related proceedings.

(2)

This Part also applies to a proceeding, in any court of a State or Territory specified in the regulations, that is:

(a)

a criminal proceeding for an offence against the law of a State or Territory; or

(b)

a related civil proceeding of a kind specified in the regulations in respect of a State or Territory; or

(c)

a proceeding under a law that is a corresponding law within the meaning of a proceeds of crime law; or

(d)

a proceeding under a law of a Territory (other than the Australian Capital Territory or the Northern Territory) that is prescribed by the regulations as a law that corresponds to a proceeds of crime law.
