Purpose of activity

In force

The purpose of an activity must be determined by having regard to:

(a)

the intention of the person undertaking the activity or that person’s belief (if any) about the intention of any foreign principal on whose behalf the activity is undertaken; and

(b)

either or both of the following:

(i)

the intention of any foreign principal on whose behalf the activity is undertaken;

(ii)

all of the circumstances in which the activity is undertaken.
