Greenhouse and Energy Minimum Standards Act 2012

The following are grounds for refusing an application under this Part:

an amount payable under this Act in relation to the application is not paid;

the application does not comply with section 64 (basic requirements for applications);

the applicant has not given the GEMS Regulator further documentation or information by the time specified in a notice given under section 65 in relation to the application;

the documentation or other information provided in the application, or as requested by a notice under section 65, is not accurate.

It is also a ground for refusing an application to register a model under section 41, or to vary a registration under section 47, that the application does not comply with section 42 (including as that section applies because of subsection 47(3)).

Section 42 contains requirements for registration applications relating to contact persons and contact details.

It is also a ground for refusing an application to register a model under section 41, or to vary a registration under section 47, that the GEMS Regulator is satisfied a person covered by subsection (4) has:

contravened a provision of this Act; or

breached a condition of a model’s registration under this Act; or

been the registrant for a registration of a model under this Act that has been:

suspended; or

cancelled (other than on application by the registrant).

The expression this Act has an extended meaning (see the Dictionary in section 5).

The persons covered by this subsection are as follows:

for an application under section 41—the applicant;

for an application under section 47—the new registrant;

in any case—a contact person nominated in the application;

if the applicant or new registrant referred to in paragraph (a) or (b) is a body corporate—any director, officer or shareholder of the body corporate who participates, or is to participate, in the management of the affairs of the body corporate.
