106QB Notification by Director or Authority that action in agreement cannot take effect

(1)

The Director may give the Determining Authority written notice that he or she is satisfied that circumstances exist that would make it impossible for an action specified in the agreement to take effect. The notice must set out the circumstances.

(2)

The Determining Authority may give the Director written notice that it is satisfied that circumstances exist that would make it impossible for an action specified in the agreement to take effect. The notice must set out the circumstances.

(3)

If the Director or the Determining Authority gives a notice under this section:

(a)

section 106R ceases to have effect in relation to the agreement; and

(b)

the Director must, within 7 days after giving or receiving the notice (as the case may be), give a copy of the notice to the Chief Executive Medicare and the person under review.
