9AA Limits on the Inspector‑General’s functions

The Inspector‑General must not, in the performance of his or her functions under section 8 or 9:

(b)

inquire into action taken by a Minister except to the extent necessary to perform the functions of the Inspector‑General referred to in subparagraphs 8(1)(a)(ii), (2)(a)(ii), (3)(a)(ii) and (4)(a)(ii) and paragraphs 8(1)(d) and 8(3A)(e); or

(ba)

inquire into action taken by the Board of ACIC or the Inter‑Governmental Committee established under the Australian Crime Commission Act 2002 except to the extent necessary to perform the functions of the Inspector‑General referred to in paragraph 8(4)(e); or

(c)

inquire into a matter, other than a matter that is referred to the Inspector‑General under subsection 65(1A) of the Australian Security Intelligence Organisation Act 1979, that is, or could be, the subject of a review by the Intelligence and Security jurisdictional area of the Administrative Review Tribunal.
