87 Compellability as a witness

(1)

A person is not obliged to comply with a subpoena or similar direction of a court or tribunal to attend and answer questions relating to a matter if:

(a)

the person:

(i)

is exercising or has exercised powers under this Act in relation to the matter; or

(ii)

is performing or has performed functions in relation to the matter; or

(iii)

is assisting or has assisted another person in the exercise of powers or the performance of functions under this Act in relation to the matter; and

(b)

the Inspector has issued a certificate under section 86 for the person in relation to the matter.

(2)

This section does not apply to a coronial inquiry.

(3)

This section has effect despite any other law.
