59 Delegation

(1)

Powers under this Part may be delegated as follows:

(a)

APRA’s powers may be delegated under section 15 of the Australian Prudential Regulation Authority Act 1998;

(b)

an inspector may by signed instrument delegate his or her powers to:

(i)

an APRA member or an APRA staff member; or

(ii)

a person included in a class of persons approved in writing by APRA for the purposes of this subparagraph.

(3)

A delegate shall, on the request of an officer of a body corporate in relation to which the delegated powers are exercisable or of a person affected by the exercise of those powers, produce the instrument of delegation, or a copy of the instrument, for inspection.
