40 Service of process

(1)

Subject to subsection (2), if a Tribunal requests the Attorney‑General to arrange for service in Australia of a process relating to a proceeding before, or an investigation conducted by, the Tribunal, the Attorney‑General may arrange for service of the process.

(2)

The Attorney‑General must not comply with the request if, in his or her opinion:

(a)

complying with the request would prejudice Australia’s sovereignty, security or national interest; or

(b)

there are special circumstances justifying non‑compliance.
