114 Crediting of amounts of compensation to the Account
This section applies where:
compensation under this Part is payable to a person in respect of loss suffered by the person;
the amount of compensation payable to the person has been determined in accordance with Division 3; and
at the end of 3 months after the determination of the amount of compensation, the person has not, because of some default or delay on the part of the person, received payment of the compensation.
The Minister may direct that an amount equal to the compensation be credited to the Account.
On crediting the Account with the compensation, the compensation must, for the purposes of section 115, be taken to have been paid to the person.
If the person rectifies the default or delay referred to in subsection (1), the Commonwealth must pay the person an amount equal to the amount credited to the Account and debit the Account accordingly.
