123 Expungement of easements

(1)

Where:

(a)

an acquiring authority owns an interest in land, being an easement; and

(b)

the Minister is satisfied that it is appropriate to extinguish the easement;

the Minister may, by notice published in the Gazette, extinguish the easement.

(2)

A notice shall identify the easement and the acquiring authority.

(3)

As soon as practicable, and, in any event, within 28 days, after an easement is extinguished under subsection (1), the Secretary of the Department shall cause to be lodged with the Registrar‑General, Registrar of Titles or other proper officer of the State or Territory in which the land is situated a copy of the notice extinguishing the easement.

(4)

The officer with whom the copy of the notice is lodged may make such entries in the records kept by the officer as are necessary having regard to the effect of subsection (1).
