72 Form and ceremony of marriage

(1)

A marriage under this Division shall be solemnised:

(a)

at such place as the authorised celebrant thinks fit, in the physical presence of at least 2 witnesses who are, or appear to the authorised celebrant to be, over the age of 18; and

(b)

according to such form and ceremony as the authorised celebrant thinks proper.

(2)

Unless, having regard to the form and ceremony of the marriage, the authorised celebrant considers it unnecessary for the parties to the marriage to do so, each of the parties shall, in some part of the ceremony and in the physical presence of the authorised celebrant and the witnesses, say to each other the words:

“I call upon the persons here present to witness that I, A.B. (or C.D.), take thee, C.D. (or A.B.), to be my lawful wedded wife (or husband, or spouse)”;

or words to that effect.
