2.12D Prescribed period for payment of unpaid amount of visa application charge (Act, subsection 64(2))
For the purposes of paragraphs 64(2)(a) and (c) of the Act, the following periods are prescribed as the periods within which an applicant must pay the second instalment of the visa application charge:
if the notice given by the Minister under subsection 64(2) is sent from a place in Australia to an address in Australia—the period beginning on the day on which the applicant is taken to have received notice and ending at the end of the 28th day after that day;
if the notice given by the Minister under subsection 64(2) is sent from:
a place outside Australia to an address in Australia; or
a place in Australia to an address outside Australia; or
a place outside Australia to an address outside Australia;
the period beginning on the day on which the applicant is taken to have received notice and ending at the end of the 70th day after that day.
If the Minister gives a person a document by a method specified in section 494B of the Act, the person is taken to have received the document at the time specified in section 494C of the Act in respect of the method.
