5.31 Infringement notice not compulsory
Nothing in this Division:
requires an infringement notice to be served on a person in relation to an offence or a contravention of a civil penalty provision; or
affects the liability of a person to be prosecuted for an offence or to be subject to proceedings in relation to a contravention of a civil penalty provision if the person does not comply with an infringement notice; or
affects the liability of a person to be prosecuted for an offence or to be subject to proceedings in relation to a contravention of a civil penalty provision if an infringement notice is not served on the person in relation to the offence or in relation to a contravention of a civil penalty provision; or
affects the liability of a person to be prosecuted for an offence or to be subject to proceedings in relation to a contravention of a civil penalty provision if an infringement notice is served and withdrawn; or
limits the amount of:
the fine that may be imposed by a court on a person convicted of an offence; or
the pecuniary penalty that may be imposed by a court on a person for a contravention of a civil penalty provision.
