Persons to whom Part applies
55 Persons to whom Part applies
This Part applies to a person if:
the person has an impairment as a result of a service injury or disease; and
the Commission has accepted liability for the injury or disease; and
the person:
is undertaking, or has completed, an approved rehabilitation program in respect of the impairment; or
has been assessed under section 44 as not having the capacity for rehabilitation.
The Commission is taken to have accepted liability for an injury or disease in certain circumstances (see section 24A).
To avoid doubt, this Part applies to a person who has an impairment as a result of an aggravated injury or disease even if the impairment resulted from the original injury or disease and not from the aggravation or material contribution.
