When prescriptions are invalid
12 When prescriptions are invalid
A prescription is not a valid Pharmaceutical benefit if the Medical Practitioner, Authorised Midwife, Authorised Nurse Practitioner, authorised nurse prescriber, participating dental practitioner or authorised optometrist:
except where the prescription is a medication chart prescription, writes a prescription for a Pharmaceutical benefit for a person where the same Medical Practitioner, Authorised Midwife, Authorised Nurse Practitioner, authorised nurse prescriber, participating dental practitioner or authorised optometrist has already written another prescription for the same benefit for that person on the same day; or
prescribes, on the one form, a Pharmaceutical benefit that is a drug of addiction and another Pharmaceutical benefit, and directs that the supply of either Pharmaceutical benefit is to be repeated (but, if no repeats of either item are ordered, the prescription may be accepted provided that this is in accordance with the relevant State or Territory law); or
prescribes a narcotic drug for the Medical Practitioner, Authorised Midwife, Authorised Nurse Practitioner, authorised nurse prescriber, participating dental practitioner or authorised optometrist who is writing the prescription; or
prescribes, on a Standard Prescription Form, an item that is not listed in the RPBS Schedule or PBS Schedule; or
prescribes, on a Standard Prescription Form, a benefit in contravention of any of the restrictions set out in paragraph 7; or
where the prescription is written by an Authorised Midwife, Authorised Nurse Practitioner, authorised nurse prescriber, participating dental practitioner or authorised optometrist for an Eligible Person—prescribes a Pharmaceutical benefit that is not available to the Eligible Person under the PBS.
a MPBS prescriber who is not a Medical Practitioner may only prescribe Pharmaceutical benefits listed on the PBS. A prescription issued by a MPBS prescriber who is not a Medical Practitioner for Pharmaceutical benefits that are not available on the PBS is not recognised under the Scheme.
