Mutual Recognition Act 1992

A reference in the law of the second State to a person registered (however described) for the second State occupation includes a reference to a person who has automatic deemed registration to carry on an activity covered by the occupation.

For the purpose of any law of a State, a person who has automatic deemed registration in the State is taken:

to have had the registration conferred by operation of the law of the State; and

not to have had the registration conferred by the operation of this Part.

One effect of this provision is that a decision of a local registration authority in a State in relation to a person’s automatic deemed registration is generally reviewable in accordance with the Acts of that State.

If a law of a State refers to a person’s registration (however described) in another State, the reference does not include a reference to automatic deemed registration.

In this section:

a reference to registration includes a reference to previous registration; and

a reference to automatic deemed registration includes a reference to previous automatic deemed registration.
