50 Information and reports for the purposes of varying or reassessing a participant’s plan

(1)

For the purposes of varying or reassessing a participant’s plan, the CEO may make one or more requests under subsection (2).

(2)

The requests the CEO may make are as follows:

(a)

that the participant, or another person, provide information that is reasonably necessary for the purposes of varying or reassessing the participant’s plan; or

(b)

that the participant do either or both of the following:

(i)

undergo an assessment and provide to the CEO the report, in the approved form, of the person who conducts the assessment;

(ii)

undergo, whether or not at a particular place, a medical, psychiatric, psychological or other examination, conducted by an appropriately qualified person, and provide to the CEO the report, in the approved form, of the person who conducts the examination.

(3)

The CEO may vary or reassess a participant’s plan before all the information and reports requested under subsection (2) are received by the CEO, but must give the participant a reasonable opportunity to provide them.

Note:

If information or reports are provided after the plan is varied or reassessed, the plan can be varied or reassessed again and if necessary replaced.
