73ZR Appointment of inspectors and investigators

(1)

The Commissioner may, in writing, appoint a person who is one of the following as an inspector, an investigator, or both, for the purposes of this Part:

(a)

a member of the staff of the Commission under section 181U;

(b)

a person assisting the Commissioner under section 181W;

(c)

a person performing services for the Commonwealth under a contract with the Commonwealth.

(2)

The Commissioner must not appoint a person mentioned in subsection (1) unless the Commissioner is satisfied that:

(a)

the person has suitable training or experience to properly exercise the powers for which the person will be authorised to use; and

(b)

the person is otherwise an appropriate person to be appointed as an inspector, investigator or both (as the case requires).

(3)

A person appointed under this section must, in exercising powers as such, comply with any directions of the Commissioner.

(4)

If a direction is given under subsection (3) in writing, the direction is not a legislative instrument.
