15B Application by a person who is not a controlling corporation
If:
a person is the responsible emitter for a facility during the whole or a part of a financial year; and
the facility is a designated large facility for the financial year; and
the person is not a controlling corporation;
the person must apply, in accordance with this section, to be registered under this Act.
Under Division 137 of the Criminal Code, it may be an offence to provide false or misleading information or documents to the Regulator in purported compliance with this Act.
However, a person is not required to make an application under subsection (1) if the person is registered under this Act at the end of the financial year.
An application under subsection (1) must be made by 31 August next following the financial year.
A person may apply, in accordance with this section, to be registered under this Act if:
the person has operational control of a facility of a kind specified in the safeguard rules; and
the person is not a controlling corporation.
An application under subsection (1) or (3A) must:
be made to the Regulator; and
be in a form approved by the Regulator; and
set out the information specified by the safeguard rules for the purposes of this paragraph.
