Upon application, the Secretary shall issue to a person a pharmaceutical benefits prescription record form in accordance with subsections (3) and (4).

Upon application, the Secretary must issue to a person an out‑patient medication prescription record form in accordance with subsections (3) and (4).

An approved pharmacist, approved medical practitioner or approved hospital authority may issue to a person a pharmaceutical benefits prescription record form in accordance with subsections (3) and (4).

A public hospital authority may issue to a person an out‑patient medication prescription record form in accordance with subsections (3) and (4).

A pharmaceutical benefits prescription record form and an out‑patient medication prescription record form must:

be in accordance with the form approved by the Secretary; and

include the prescribed particulars of the person to whom the form is issued.

A pharmaceutical benefits prescription record form or an out‑patient medication prescription record form issued to a person may include the prescribed particulars of any person who is a member of the person’s family and:

is not a holder of an entitlement card.

Where a pharmaceutical benefits prescription record form or an out‑patient medication prescription record form is issued to a person, the person and each member of the person’s family whose particulars are included in the form in accordance with subsection (4) shall be taken, for the purposes of this section, to be a holder of the form.

Where:

an approved pharmacist, approved medical practitioner or approved hospital authority supplies a pharmaceutical benefit or repatriation pharmaceutical benefit to a holder of a pharmaceutical benefits prescription record form;

the form is presented at the time of supply; and

the supply is:

a supply of a pharmaceutical benefit to be taken into account under subsection 84C(4) for the purposes of section 84C; or

a supply of a repatriation pharmaceutical benefit to be taken into account, under subsection 84C(4A), for the purposes of section 84C;

A record made for the purposes of subsection (6) shall include:

the prescribed particulars of the prescription upon which the pharmaceutical benefit or repatriation pharmaceutical benefit is supplied;

the date on which the pharmaceutical benefit or repatriation pharmaceutical benefit is supplied; and

such other particulars in relation to the supply of the pharmaceutical benefit or repatriation pharmaceutical benefit as are prescribed;

in a case where the record is made by an approved pharmacist—the pharmacist;

in a case where the record is made by an approved medical practitioner—the medical practitioner; or

in a case where the record is made by an approved hospital authority—the medical practitioner or pharmacist by or under whose supervision the pharmaceutical benefit or repatriation pharmaceutical benefit is dispensed.

An approved pharmacist may authorise a person to record, on behalf of the pharmacist, the supply of pharmaceutical benefits and repatriation pharmaceutical benefits for the purposes of subsection (6).

A reference in subsection (7) to an approved pharmacist includes a reference to a person authorised by a pharmacist under subsection (8) to record, on behalf of the pharmacist, the supply of pharmaceutical benefits and repatriation pharmaceutical benefits.

Where:

an out‑patient medication is supplied to the holder of an out‑patient medication prescription record form; and

the form is presented at the time of supply; and

the supply is not excluded under subsection 84C(4B) from being taken into account for the purposes of section 84C;

A record made for the purposes of subsection (10) must include:

the prescribed particulars of the prescription upon which the medication is supplied; and

the date on which the medication is supplied; and

any other particulars of the supply that are prescribed;

The public hospital authority of a public hospital may authorise in writing a person employed at the hospital to record, for the purposes of subsection (10), the supply of an out‑patient medication dispensed by, or under the supervision of, a medical practitioner or pharmacist.
