Secretary may impose conditions
60AM Secretary may impose conditions
This section applies to an entity if the entity gives the Secretary a temporary handling report for a particular sample of a security‑sensitive biological agent.
The Secretary may, by writing, impose conditions on the handling of the sample by the entity.
The Secretary must not impose a condition under subsection (2) unless the Secretary is satisfied that it is reasonably necessary to do so, having regard to:
the security risks posed by the handling of the security‑sensitive biological agent by the entity; and
any other matters the Secretary considers relevant.
An instrument under subsection (2) is not a legislative instrument.
