184 Delegation by the Operator
Powers and functions—general
The Operator may, in writing, delegate all or any of the Operator’s powers or functions under this Act (other than sections 29, 75, 185 and 190) to an officer of the scheme.
In exercising a power or performing a function under a delegation under subsection (1), the delegate must comply with any directions of the Operator.
Powers and functions—redress determinations
The Operator may, in writing, delegate the Operator’s powers and functions under section 29 or 75 (which are about determinations relating to redress applications) to an independent decision‑maker.
In exercising a power or performing a function under a delegation under subsection (3), the delegate is not required to comply with any directions of the Operator.
Powers and functions—engaging independent decision‑makers
The Operator may, in writing, delegate the Operator’s powers or functions under section 185 (which are about engaging independent decision‑makers) to an SES employee, or an acting SES employee, in the Department.
In exercising a power or performing a function under a delegation under subsection (5), the delegate must comply with any directions of the Operator.
A reference in this section to section 29 or 75 includes a reference to that section as it applies in relation to a reassessment decision because of sections 71D and 71U.
