46B Notice to partly‑participating institutions

(1)

If:

(a)

a person accepts or declines an offer of redress in accordance with section 42 or 45; and

(b)

the offer specified an institution under subparagraph 39(ia)(i), and a funder of last resort for the institution under subparagraph 39(ia)(ii); and

(c)

the institution is a partly‑participating institution;

then the Operator must give the institution a written notice in accordance with subsection (2) of this section.

(2)

The notice must state:

(a)

that the Operator determined under paragraph 29(2)(j) that the institution was responsible for the abuse; and

(b)

the reasons for the determination under section 29, as they relate to the institution; and

(c)

whether the person accepted or declined the offer; and

(d)

if the person accepted the offer—whether the person wishes to receive a direct personal response from the institution.

(3)

The notice must also comply with any requirements prescribed by the rules.
