151 Hearings
(1)
For the purposes of an inquiry, the Tribunal may hold hearings.
Determinations “on the papers”
(2)
The Tribunal may:
(a)
decide for the purposes of paragraph 24DL(2)(c) whether it would be fair and reasonable to register an agreement; or
(b)
make a determination in relation to a right to negotiate application;
by considering, without holding a hearing, the documents or other material lodged with or provided to the Tribunal. However, the Tribunal must hold a hearing if it appears to the Tribunal that the issues for determination cannot be adequately determined in the absence of the parties.
