127 Machinery and equipment checks and tests on vessels
The master of a regulated Australian vessel or a foreign vessel must ensure:
that checks and tests of the machinery and equipment of the vessel are conducted as required by the regulations; and
that entries are made in the vessel’s official logbook, in accordance with the regulations, in relation to such checks and tests.
Without limiting subsection (1), the master of a vessel contravenes that subsection if the master does not implement and maintain a safety management system that ensures that the checks and tests are carried out, and the entries are made.
Fault‑based offence
A person commits an offence if the person contravenes subsection (1).
Penalty: Imprisonment for 5 years or 300 penalty units, or both.
Civil penalty
A person is liable to a civil penalty if the person contravenes subsection (1).
Civil penalty: 3,000 penalty units.
