135 Taking vessels to sea without pollution certificates—owner
The owner of a vessel must not take the vessel to sea, or cause or permit another person to take the vessel to sea, if:
the vessel is required by the regulations to have a pollution certificate of a specified kind; and
a pollution certificate of that kind is not in force for the vessel.
Fault‑based offence
A person commits an offence if the person contravenes subsection (1).
Penalty: Imprisonment for 10 years or 600 penalty units, or both.
Civil penalty
A person is liable to a civil penalty if the person contravenes subsection (1).
Civil penalty: 6,000 penalty units.
