185 Reporting of marine incidents to AMSA—owner
An owner of a vessel contravenes this subsection if:
the vessel is involved in a marine incident that has affected, or is likely to affect, the safety, operation or seaworthiness of the vessel; and
neither the owner nor the master of the vessel gives a written report of the incident in the approved form to AMSA, within the period prescribed by the regulations, after the owner becomes aware of the incident.
An owner of a vessel contravenes this subsection if:
the vessel is involved in, or causes, a marine incident that involves:
the death of a person; or
serious injury to a person; or
the loss of a vessel; or
the loss of a person from the vessel; or
significant damage to a vessel; or
loss of cargo of a vessel; and
neither the owner nor the master of the vessel reports the incident to AMSA, within the period prescribed by the regulations, after the owner becomes aware of the incident.
Fault‑based offence
A person commits an offence if the person contravenes subsection (1) or (2).
Penalty: 60 penalty units.
Civil penalty
A person is liable to a civil penalty if the person contravenes subsection (1) or (2).
Civil penalty: 600 penalty units.
