149 Defences to offence of engaging in prohibited or restricted activities
Section 148 does not apply if:
(a)
the conduct was necessary to save a life or vessel; or
(b)
the conduct was necessary to prevent pollution; or
(c)
the defendant took all reasonable steps to avoid engaging in the conduct.
Note:
A defendant bears an evidential burden in relation to the matter in this section (see subsection 13.3(3) of the Criminal Code).
