17 Petroleum environmental inspections—civil proceedings
(1)
This Schedule does not:
(a)
confer a right of action in any civil proceeding in respect of any contravention of a provision of a petroleum environmental law; or
(b)
confer a defence to an action in any civil proceeding or otherwise affect a right of action in any civil proceeding.
(2)
However, subclause (1) does not apply in relation to the enforcement, for the purposes of Division 4 of Part 6.5 of this Act, of a petroleum environmental law that is a civil penalty provision.
