A person is neither liable to a proceeding, nor subject to a liability, under an enactment merely because the person, in good faith and in relation to the Overseas Students Ombudsman’s functions or powers:
gives information to the Overseas Students Ombudsman (other than in accordance with a requirement under section 9); or
gives a document or other record to the Overseas Students Ombudsman (other than in accordance with a requirement under section 9).
For information, documents or other records given in accordance with a requirement under section 9, see subsections 9(4) and (5).
To avoid doubt, subsection (1) does not prevent the person from being liable to a proceeding, or being subject to a liability, for conduct of the person that is revealed by the information, document or record given to the Overseas Students Ombudsman.
This section does not limit section 37.
