63G Commissioner may obtain information and documents about compliance
Scope
This section applies to a person if the Commissioner believes on reasonable grounds that the person has information or documents relevant to compliance by a provider of an electronic service that is or may be an age‑restricted social media platform with section 63D or subsection 63DA(1) or 63DB(1).
This section also applies to a person if the Commissioner believes on reasonable grounds that the person has information or documents relevant to whether an electronic service is a service specified in the legislative rules for the purposes of paragraph 63C(1)(b) or (6)(b).
Requirement
The Commissioner may, by written notice given to a person to whom this section applies, require the person to do either or both of the following:
give to the Commissioner any information mentioned in subsection (1) or (2) (as applicable), within the period and in the manner specified in the notice;
produce to the Commissioner any documents mentioned in subsection (1) or (2) (as applicable), within the period and in the manner specified in the notice.
However, the notice must not require the person to give information or produce documents by summoning the person to attend before the Commissioner or other person.
