Use of HCFC

In force

(1)

A person contravenes this subsection if:

(a)

the person uses an HCFC; and

(b)

the HCFC was manufactured or imported on or after 1 January 2020; and

(c)

the use is not for a purpose prescribed by the regulations for the purposes of this paragraph.

Fault‑based offence

(2)

A person commits an offence if the person contravenes subsection (1).

Note:

The physical elements of an offence against this subsection are set out in subsection (1) (see subsection 6B(3)).

Penalty: 300 penalty units.

Strict liability offence

(3)

A person commits an offence of strict liability if the person contravenes subsection (1).

Penalty: 60 penalty units.

Civil penalty provision

(4)

A person is liable to a civil penalty if the person contravenes subsection (1).

Civil penalty: 400 penalty units.
