Ozone Protection and Synthetic Greenhouse Gas Management Act 1989

The following provisions are subject to monitoring under Part 2 of the Regulatory Powers Act:

each provision of this Act and the regulations;

an offence provision of the Crimes Act 1914 or the Criminal Code, to the extent that it relates to one or more of the provisions mentioned in paragraph (a).

Part 2 of the Regulatory Powers Act creates a framework for monitoring whether the provisions mentioned in this subsection have been complied with. It includes powers of entry and inspection.

Information given in compliance or purported compliance with a provision of this Act or the regulations is subject to monitoring under Part 2 of the Regulatory Powers Act.

Part 2 of the Regulatory Powers Act creates a framework for monitoring whether the information is correct. It includes powers of entry and inspection.

For the purposes of Part 2 of the Regulatory Powers Act, as that Part applies in relation to the provisions mentioned in subsection (1) and the information mentioned in subsection (2):

the following provisions of the Customs Act 1901 are related to the provisions and the information:

subsections 50(4) and (7) (prohibited imports);

subsections 112(2B) and (2BC) (prohibited exports);

an inspector is an authorised applicant; and

an inspector is an authorised person; and

a magistrate is an issuing officer; and

the CEO is the relevant chief executive; and

a designated court is a relevant court.

An authorised person may be assisted by other persons in exercising powers or performing functions or duties under Part 2 of the Regulatory Powers Act in relation to the provisions mentioned in subsection (1), and the information mentioned in subsection (2).

Part 2 of the Regulatory Powers Act, as that Part applies in relation to the provisions mentioned in subsection (1) and the information mentioned in subsection (2), extends to every external Territory.
