67A Delegation by the Minister

(1)

The Minister may, by writing, delegate all or any of his or her powers and functions under this Act or the regulations to:

(aa)

the Secretary; or

(a)

an SES employee or acting SES employee in the Department; or

(b)

an APS employee who holds, or is acting in, an Executive Level 2, or equivalent, position in the Department.

(2)

Subsection (1) does not apply to the Minister’s powers under section 19A.

(3)

In exercising powers or functions under a delegation, the delegate must comply with any directions of the Minister.
