25 Right to apply for PBR is personal property
(1)
The right of a breeder of a plant variety to apply for PBR is personal property and is capable of assignment and of transmission by will or by operation of law.
(2)
An assignment of a right to apply for PBR must be in writing signed by or on behalf of the assignor.
Note:
The Personal Property Securities Act 2009 deals with security interests in personal property, including a right to apply for PBR.
