21 CEO may require recorded information
The CEO may, by notice in writing, require a person to give the CEO information that the person is required by the rules to keep in a record, if the CEO reasonably suspects that:
a provision of this Act has been contravened or is being contravened; and
the information is relevant to the suspected contravention.
The notice must:
identify the information that must be given to the CEO; and
state the day the information must be given by, which must be a reasonable period after the notice is given to the person.
The CEO may, on application by the person, change the day the information must be given by to a later day.
A person contravenes this subsection if:
the person is required to give information under this section; and
the person fails to comply with the requirement.
Strict liability offence
A person commits an offence of strict liability if the person contravenes subsection (4).
Penalty: 40 penalty units.
Civil penalty provision
A person is liable to a civil penalty if the person contravenes subsection (4).
Civil penalty: 80 penalty units.
