23E Election to not create certificates under this Subdivision
The owner of a qualifying small generation unit at the time that it is installed may give the Regulator a notice in writing electing that this Subdivision does not apply to the creation of certificates that relate to the unit.
Timing of election
The owner must make the election within the period of 28 days beginning on the day the unit is installed and before any certificates are created under this Subdivision that relate to the unit.
Effect of election
If an election is made, a person must not create certificates under this Subdivision that relate to the unit.
A person may be able to create certificates under Subdivision A that relate to the unit.
Election cannot be altered
An election must not be varied or revoked.
Definition
In this section:
qualifying small generation unit means a small generation unit of a kind prescribed by the regulations for the purposes of this section.
