30N If there is a certificate on the clearing house transfer list—Regulator to transfer certificate
Scope
This section applies if:
a person (the purchaser) has made an application in accordance with section 30M to purchase a small‑scale technology certificate; and
there is a small‑scale technology certificate on the clearing house transfer list.
Regulator to transfer certificate at top of clearing house transfer list
The Regulator must transfer the certificate that is at the top of the clearing house transfer list to the purchaser on behalf of the person (the seller) who, immediately before the transfer, was the registered owner of that certificate.
If the Regulator transfers a certificate under subsection (2), the Regulator must, as soon as practicable:
give the purchaser notice in writing of the transfer; and
pay the seller the amount specified in subsection (4); and
alter the register of small‑scale technology certificates to show the purchaser as the owner of the certificate.
For the purposes of paragraph (3)(b), the amount is:
if the transfer of the certificate is a taxable supply by the seller to the purchaser—the GST inclusive clearing house price; or
if the transfer of the certificate is not a taxable supply by the seller to the purchaser—the clearing house price.
Ownership of the certificate transfers to the purchaser when the register of small‑scale technology certificates is altered in accordance with paragraph (3)(c).
