Royal Commissions Act 1902

A Commission, a member of a Commission or a person who is an authorised person in relation to a Commission may:

inspect any documents or other things:

produced before, or delivered to, the Commission; or

produced or given under a notice under subsection 2(3A) or (3C) or 6AA(3); and

retain the documents or other things for so long as is reasonably necessary for the purposes of the inquiry to which the documents or other things are relevant; and

in the case of documents:

produced before, or delivered to, the Commission; or

produced or given under a notice under subsection 2(3A) or (3C) or 6AA(3);

Where the retention of a document or other thing by a Commission ceases to be reasonably necessary for the purposes of the inquiry to which the document or other thing is relevant, the Commission shall, if a person who appears to the Commission to be entitled to the document or other thing so requests, cause the document or other thing to be delivered to that person unless the Commission has furnished the document or other thing to a person or body referred to in paragraph 6P(1)(a), (aa), (c), (d), (da) or (e) or subsection 6P(2), (2A) or (2B).

Subsection (2) has effect subject to subsection 9(10).

In subsection (1), a reference to a person who is an authorised person in relation to a Commission is a reference to a person authorised in writing, or a person included in a class of persons authorised in writing, for the purposes of that subsection by:

in relation to an authorised member hearing—the member of the Commission presiding at the hearing; and

in relation to a Commission that is constituted by 2 or more members (except if paragraph (a) applies)—the President or Chair of the Commission; and

in relation to a sole Commissioner—the Commissioner.
