Action for compensation
73 Action for compensation
An action for compensation for damage to which this Part applies may only be brought:
within one year after the day on which the damage occurred; or
if, when the damage occurred, the person bringing the action did not know that it had occurred—within one year after the day on which the person:
became aware of the damage; or
would have become aware of the damage, if the person had exercised due diligence.
If, in accordance with the Liability Convention or otherwise under international law:
a foreign country has presented a claim against Australia for compensation for damage caused by a space object to which an Australian launch permit, overseas payload permit, return authorisation or authorisation certificate relates; or
such a claim made by a foreign country has been settled;
a person who has suffered damage covered by the claim may not commence an action, against the responsible party, seeking compensation for that damage.
