Superannuation Act 1922

Where the Board is satisfied that any pension or benefit has, whether before or after the commencement of this section, become payable under this Act as the result of the service of a contributor as a member of the Forces, the Commonwealth shall pay to the Fund the amount by which the proportion of the pension or benefit equivalent to the contributions made by the contributor is less than the amount of the pension or benefit.

In this section the expression the Forces means:

the Naval, Military or Air Forces of the Commonwealth, of the United Kingdom or of any other part of the Sovereign’s dominions;

any nursing service or women’s auxiliary or other service established in connexion with any of the Forces specified in the last preceding paragraph; and

any other service which the Minister, by order published in the Gazette, declares to be included in the Forces for the purposes of this section.
