Telecommunications Act 1997

This section applies if the ACMA reasonably believes that a person:

is contravening a designated civil penalty provision; or

has contravened a designated civil penalty provision in circumstances that make it likely that the contravention will continue or be repeated; or

is likely to contravene a designated civil penalty provision.

For designated civil penalty provision, see section 372JH.

The ACMA may give the person a written notice requiring the person to:

remedy the contravention; or

prevent the likely contravention from occurring; or

remedy the things or operations causing the contravention or likely contravention.

A notice under subsection (2) is to be known as a remedial notice.
