4 ACMA may declare a protection zone
The ACMA may, by legislative instrument, declare a protection zone in relation to one or more submarine cables, or one or more submarine cables that are proposed to be installed, in Australian waters.
The ACMA must not declare a protection zone in relation to one or more domestic submarine cables, or one or more domestic submarine cables that are proposed to be installed, unless:
the cable or cables are specified in the regulations; or
the route or routes of the proposed cable or cables are specified in the regulations.
Before the ACMA declares a protection zone, the ACMA must comply with Subdivision B.
Subdivision B requires the ACMA to develop a proposal for the protection zone and to consult about the proposal, and to satisfy other prerequisites.
