547A Powers available to inspectors for monitoring compliance
For the purpose of finding out whether the Spam Act 2003 has been complied with, an inspector may:
enter any premises; and
exercise the monitoring powers set out in section 547B.
An inspector is not authorised to enter premises under subsection (1) unless:
the occupier of the premises has consented to the entry; or
the entry is made under a warrant under section 547D.
Consent
Before obtaining the consent of a person for the purposes of paragraph (2)(a), the inspector must inform the person that he or she may refuse consent.
An entry of an inspector by virtue of the consent of a person is not lawful unless the person voluntarily consented to the entry.
