Telecommunications Act 1997

This section applies to a decision of a kind referred to in section 555, other than a decision of a kind specified in Part 2 of Schedule 4.

If this Act provides for a person to make an application to the ACMA for such a decision, the ACMA must make the decision:

within 90 days after receiving the application; or

if the ACMA has, within those 90 days, given the applicant a written request for further information about the application—within 90 days after receiving that further information.

The ACMA is taken, for the purposes of this Part, to have made a decision to refuse the application if it has not informed the applicant of its decision before the end of the relevant period of 90 days.
