The penalty to be specified in an infringement notice given to a body corporate must be a pecuniary penalty equal to:

if the alleged contravention is of a kind specified in a determination under subsection (2)—the number of penalty units specified in the determination in relation to that kind of contravention; or

otherwise—60 penalty units.

For the purposes of paragraph (1)(a), the Minister may, by legislative instrument, make a determination that:

sets out one or more kinds of contraventions of section 68 or 101; and

for each kind of contravention set out in the determination, specifies a particular number of penalty units.

The number of penalty units specified in a determination for a particular kind of contravention must not exceed 18,000.

The penalty to be specified in an infringement notice given to a person other than a body corporate must be a pecuniary penalty equal to 12 penalty units.
