33 Advertisements for sale of protected underwater cultural heritage must include permit number

(1)

This section applies if:

(a)

a permit granted under section 23 is in force; and

(b)

the permit authorises the sale of protected underwater cultural heritage.

(2)

A person contravenes this subsection if the person:

(a)

advertises the protected underwater cultural heritage for sale; and

(b)

the unique number of the permit specified under paragraph 23(5)(f) is not included in the advertisement.

(3)

A person commits an offence if the person contravenes subsection (2).

Penalty: Imprisonment for 2 years or 120 penalty units, or both.

(4)

A person commits an offence of strict liability if the person contravenes subsection (2).

Penalty: 60 penalty units.

(5)

A person is liable to a civil penalty if the person contravenes subsection (2).

Civil penalty: 120 penalty units.
