Minimum water efficiency

In force

(1)

A person contravenes this subsection if:

(a)

the person supplies a WELS product; and

(b)

the applicable WELS standard requires the product:

(i)

to be registered for the purposes of the supply; and

(ii)

to comply with minimum water efficiency requirements for the purposes of the supply; and

(c)

the product does not comply with those minimum water efficiency requirements.

Strict liability offence

(2)

A person commits an offence of strict liability if the person contravenes subsection (1).

Penalty: 60 penalty units.

Note:

For strict liability, see section 6.1 of the Criminal Code.

Civil penalty provision

(3)

A person is liable to a civil penalty if the person contravenes subsection (1).

Civil penalty: 60 penalty units.
