16 Injunctions

Enforceable provisions

(1)

A provision is enforceable under Part 7 of the Regulatory Powers Act if it is an offence against this Act.

Note 1: The expression offence against this Act has an extended meaning (see section 3).

Note 2: Part 7 of the Regulatory Powers Act creates a framework for using injunctions to enforce provisions.

Authorised person

(2)

For the purposes of Part 7 of the Regulatory Powers Act, the Minister is an authorised person in relation to the provisions mentioned in subsection (1).

(3)

The Minister may, in writing, delegate the Minister’s powers and functions as an authorised person to an officer of the Department in relation to the provisions mentioned in subsection (1).

Relevant court

(4)

For the purposes of Part 7 of the Regulatory Powers Act, the Federal Court of Australia is a relevant court in relation to the provisions mentioned in subsection (1).

Extension to external Territories

(5)

Part 7 of the Regulatory Powers Act, as it applies in relation to the provisions mentioned in subsection (1), extends to every external Territory.
